Payroll records Los Angeles County nursing homes filed with Medicare for April through June 2026 show a median of 4.32 nursing hours per resident per day, below the California average of 4.54 that CMS published for the same period. 362 of 364 facilities staffed fewer hours per resident on weekends than on weekdays. By our count from the same payroll data, 160 facilities fell below California’s 3.5-hour direct care minimum on at least one day. Los Angeles County has 32% of California’s Medicare-certified nursing homes but 56% of the federal fines CMS lists ($15.4 million of $27.2 million). In their 2025 reports to the state, county nursing homes listed $5.96 billion in health care revenue and $381.4 million in combined net income.

Days below California’s 3.5-hour minimum

California requires most skilled nursing facilities to provide at least 3.5 direct care hours per patient day (Health and Safety Code 1276.65). These counts are our calculation from CMS payroll data (RN, LVN and nurse aide hours), not CDPH findings; CDPH counts some staff differently and can grant waivers. Hospital-based units, which the rule exempts, are left out.

Talk to a Los Angeles nursing home abuse lawyer

Beverly Law represents residents and families in claims against nursing homes for abuse, neglect, bed sores, falls and fractures, sexual abuse, dehydration and malnutrition, medication errors and wrongful death. We start with the same public record shown on these pages, then request the resident’s chart and staffing records.

California’s Elder Abuse and Dependent Adult Civil Protection Act allows added remedies, including attorney fees, when neglect or abuse is proven to be reckless, oppressive, fraudulent or malicious (Welfare and Institutions Code section 15657). Filing deadlines can be as short as one year depending on the claim, so talk to a lawyer early. The consultation is free, in English or Spanish, and you owe no fees and no costs unless we win. Call (310) 552-6959.

Questions

How many nursing hours should a nursing home resident get?

California requires most skilled nursing facilities to provide at least 3.5 direct care hours per patient day, including 2.4 hours from certified nurse assistants. In April to June 2026 the California average CMS published was 4.54 total nursing hours per resident per day.

Where does this data come from?

Staffing comes from the payroll data nursing homes file with CMS (Payroll-Based Journal); owners, turnover and fines from the CMS Provider Data Catalog; revenue, profit and related-party payments from the annual reports nursing homes file with HCAI.

Can understaffing lead to a lawsuit?

Understaffing by itself is a regulatory issue, but when a resident is hurt because care the plan required was not given (missed turning, falls without supervision, dehydration), staffing records are often key evidence in a neglect or elder abuse claim.

How much does a nursing home abuse lawyer cost?

Beverly Law takes nursing home cases on contingency: the consultation is free and you owe no attorney fees and no costs unless we recover money for you.
