July 2023: Class A citation after a resident's finger was fractured during a shower given by a CNA

According to the citation, CDPH received a complaint on October 24, 2022, and made an unannounced visit on October 27. Resident 1, a 75-year-old woman who could understand and make her own decisions, told inspectors that on October 22, CNA 1 sprayed her with very hot water during a shower. She said that when she raised her hands to protect her face, CNA 1 threw the shower head on the floor, grabbed her right hand and pushed her fingers backward with her weight, and did not stop when she yelled that her hand was breaking.

Inspectors found the resident reported the incident to a CNA and a licensed vocational nurse that night, and the nurse saw that her right hand was swollen and bluish-purple. A family member told inspectors a different nurse said the resident had hit herself, and the family member asked for an X-ray. The X-ray on October 24 showed a fracture of the right pinky finger. A hospital emergency department splinted the finger and sent her back to the facility. On October 27, inspectors saw purple and green bruising at the base of her fourth and fifth fingers. The facility's own final report found she was mishandled during care.

CDPH found the facility failed to protect Resident 1 from physical abuse by CNA 1 and failed to follow its abuse prohibition policy. CDPH issued a Class A citation with a $25,000 penalty, and the department determined the violations presented either imminent danger or a substantial probability of death or serious physical harm.

Sexual abuse reports at Gardena Convalescent Center

Cal Health Find lists 1 intake for Gardena Convalescent Center from 2023 through October 30, 2026 that included an allegation CDPH classified as sexual abuse (0 from complaints and 1 reported by the facility itself). CDPH substantiated a sexual abuse allegation in 0 of them. Federal rules require a nursing home to report an abuse allegation to the state within two hours, so a facility-reported incident means staff raised the allegation, not that it was proven. “Unsubstantiated” means CDPH did not find enough evidence; it does not mean nothing happened.

Warning signs include bruising or bleeding in the genital area or inner thighs, a new genital infection, torn or stained underclothing, and a resident who suddenly fears a particular staff member or resists being bathed or changed. If you suspect sexual abuse, call 911 or local police first, ask that the resident not be bathed before a medical exam, and then report it to CDPH and the long-term care ombudsman. What this record means for your family

California uses classes for state citations. Under Health and Safety Code section 1424 ↗, a Class AA citation is a Class A violation that CDPH determined was a direct proximate cause of a resident’s death. A Class A citation means CDPH found an imminent danger, or a substantial probability, that death or serious physical harm would result. Class B covers violations with a direct or immediate relationship to residents’ health, safety or security.

Federal deficiencies carry a letter from A to L. G, H and I mean inspectors found actual harm to residents; J, K and L mean immediate jeopardy, the most serious level. F600 is the federal rule that residents be free from abuse and neglect; F609 and F610 cover reporting and investigating allegations; F689 covers accidents and supervision; F686 covers pressure injuries.

Warning signs worth asking about: unexplained bruises or fractures, new bed sores, sudden weight loss or dehydration, a resident who becomes fearful or withdrawn around certain staff, and calls that go unanswered.
