May 2023: Class A citation over the fall risk assessment and care plan of a resident who fell
On March 10, 2023, CDPH made an unannounced visit to investigate a facility-reported incident about a death and quality of care. According to the citation, Resident 1, a 70-year-old woman, was readmitted on January 27, 2023, with diagnoses including chronic obstructive pulmonary disease (COPD) and seizures. Her assessment said she needed total help from two staff for bed mobility, transfers and walking.
CDPH found that on her January 28, 2023, fall risk assessment, RN 1 did not count her seizure diagnosis. She scored 16, which the form rated low risk. With the seizures counted she would have scored 20, above the high-risk cutoff of 18. The director of nursing told inspectors the assessment was done incorrectly. According to the citation, the facility did not hold a fall risk interdisciplinary team meeting, and her care plans for restlessness, started February 27 and March 1, 2023, did not include interventions to address safety concerns after she was found sitting up in bed on two occasions.
The citation states that as a result, Resident 1 fell on March 9, 2023. Staff found her on the floor next to her bed at 7:11 p.m., unresponsive, with no pulse and a cut on the back of her head. Staff started CPR and called 911, and paramedics pronounced her dead at 7:46 p.m. According to the citation, the penalty was first set at $100,000. CDPH records show the facility appealed, and the citation was closed as Class A with a $25,000 penalty.

What this record means for your family
California uses classes for state citations. Under Health and Safety Code section 1424 ↗, a Class AA citation is a Class A violation that CDPH determined was a direct proximate cause of a resident’s death. A Class A citation means CDPH found an imminent danger, or a substantial probability, that death or serious physical harm would result. Class B covers violations with a direct or immediate relationship to residents’ health, safety or security.
Federal deficiencies carry a letter from A to L. G, H and I mean inspectors found actual harm to residents; J, K and L mean immediate jeopardy, the most serious level. F600 is the federal rule that residents be free from abuse and neglect; F609 and F610 cover reporting and investigating allegations; F689 covers accidents and supervision; F686 covers pressure injuries.
Warning signs worth asking about: unexplained bruises or fractures, new bed sores, sudden weight loss or dehydration, a resident who becomes fearful or withdrawn around certain staff, and calls that go unanswered.
