Everyone is responsible for injuries caused to others by their want of ordinary care or skill. In a Los Angeles crash, liability may be shared among drivers, employers, or public agencies.
You generally have two years from the date of injury to file a personal injury lawsuit in California. Claims against public entities must be presented within six months.
California is not a no-fault state. Juries assign a percentage of fault to everyone involved and reduce damages by that percentage — with no cutoff. Even if you are found 90% at fault, you still recover 10% of your damages. If your damages are $100,000 and you are 30% at fault, you recover $70,000.

Where Your Los Angeles Case Gets Filed
Los Angeles County Superior Court is the largest trial court in the United States. Since the Personal Injury Hub at the Spring Street Courthouse was wound down, personal injury cases are assigned to Independent Calendar courtrooms in the district where the crash happened — for the Central District, that means the Stanley Mosk Courthouse at 111 N. Hill Street.
A Van Nuys crash, a Santa Monica crash and a Compton crash can each land in a different courthouse, with different judges and different timelines. You don’t need to figure this out — we do. But it is the reason a firm that actually tries cases in LA County is not interchangeable with one that doesn’t.

How long do I have to file a personal injury lawsuit in California?
Generally two years from the date of the injury (Code Civ. Proc. § 335.1). If your claim is against a public entity — the City of Los Angeles, LA Metro, LAUSD — you must present a government claim within six months. That shorter deadline is the one people miss.
Is California a no-fault state for car accidents?
No. California is an at-fault state with pure comparative negligence, so the driver who caused the crash pays — and your recovery is reduced by whatever percentage of fault is assigned to you.
Can I still recover if the accident was partly my fault?
Yes. California has no cutoff. Even at 90% at fault you recover 10% of your damages.
How much is my Los Angeles car accident case worth?
It depends on the severity and permanence of the injury, your treatment record, how clear fault is, and how much insurance coverage is available. Any lawyer who quotes a number before reading the file is guessing.
What should I do right after a car accident in Los Angeles?

Your own uninsured/underinsured motorist coverage may pay. It also typically covers hit-and-run crashes.
Who pays my medical bills after a car accident in California?
Usually your own health insurance or MedPay first, reimbursed out of the settlement. The at-fault driver’s insurer generally does not pay bills as you go.
How do I get a copy of my LAPD traffic collision report?
Through LAPD Records with the report number, date and location. We pull the report for our clients as part of the case, at no cost.
What can I do if I was hit by a hit-and-run driver in Los Angeles?
Report it to LAPD immediately and open a claim under your uninsured motorist coverage. Hit-and-run killed 98 people in LA in 2024 — you are not out of options.
Can I file a personal injury claim in California if I’m undocumented?
Yes. Immigration status does not bar you from bringing a personal injury claim or from recovering damages in California.
How long does a personal injury case take?
