What the Law Says

California Vehicle Code Section 21712 makes it unlawful for a pedestrian to walk, remain, or be upon a railroad track or right-of-way except at a designated crossing. When a pedestrian death or injury occurs on rail property, investigators examine whether adequate warning devices, signage, and crossing gates were in place, since a transit agency can share liability if the crossing was not reasonably safe.

California Code of Civil Procedure Section 377.60 governs wrongful death claims, allowing surviving family members to seek compensation for the loss of a loved one killed through another party’s negligence, including a public transit operator. Government Claims Act procedures under Government Code Section 911.2 also require that any claim against Metro, a public agency, be filed within six months of the incident, a far shorter deadline than in claims against private parties.
