If a big rig, tractor-trailer, box truck or other commercial vehicle hit you on the I-15, US-395 or a surface street in Hesperia, get medical care now and do not sign anything from the trucking company’s insurer until a lawyer has read it. Beverly Law sends a preservation letter to the carrier within days so the truck’s electronic logs, dash-cam video and inspection records are not lost, then builds the claim against every company that shares responsibility.

Our office is in Los Angeles (4929 Wilshire Blvd, Suite 960, Los Angeles, CA 90010). We represent Hesperia clients by phone, video and in-person meetings by appointment, and a Hesperia lawsuit is filed in the Victorville courthouse of the San Bernardino County Superior Court (14455 Civic Drive, Victorville, CA 92392). Free consultation, 24/7, in English and Spanish. No attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement.

Why Truck Accidents Happen in Hesperia

The roads, the freight and the numbers

Hesperia is the first High Desert city north of the Cajon Pass, and the I-15 through town carries the freight that moves between the Los Angeles basin, Barstow and Las Vegas. Trucks come down the grade with hot brakes, climb it in the slow lanes while commuter traffic weaves around them, and share the Main Street, Ranchero Road and Bear Valley Road interchanges with local drivers. US-395 adds a second truck corridor on the west side of the valley, a two-lane highway for much of its length where a drifting semi has nowhere to go but the oncoming lane.

The crashes the firm has covered on this stretch show the pattern: a multi-vehicle DUI crash with a car fire on the southbound 15 Freeway in Hesperia, a semi that crossed into oncoming traffic on Palmdale Road (SR-18) a few miles north in Adelanto and killed a driver, and a five-vehicle pileup on Highway 395 in Adelanto that sent five people to hospitals. Add high winds in the Cajon Pass, summer heat that blows tires, and the Hesperia Road and Phelan Road grade crossings, and you have the reasons a truck claim here usually turns on driver fatigue, following distance and brake maintenance.

Where you are treated and where the case is filed both matter. The nearest trauma centers are Arrowhead Regional Medical Center in Colton (Level II) and Loma Linda University Medical Center (Level I); the closest emergency rooms are Victor Valley Global Medical Center and Desert Valley Hospital in Victorville and Providence St. Mary Medical Center in Apple Valley. Critically injured crash victims from the I-15 are often flown out by helicopter. If the claim does not settle, the lawsuit is filed in the Victorville courthouse of the San Bernardino County Superior Court (14455 Civic Drive, Victorville, CA 92392); injury cases from across the Victor Valley are heard there.

What California Law Says About Truck Accidents

FEDERAL TRUCKING RULES — 49 CFR PARTS 390–399

Interstate carriers must follow the Federal Motor Carrier Safety Regulations (49 CFR § 390 et seq.): driver qualification files, drug and alcohol testing, cargo securement and vehicle inspection and maintenance (Part 396). A violation of a safety regulation is powerful evidence of negligence, and it exposes the carrier, not just the driver.

HOURS OF SERVICE AND ELECTRONIC LOGS — 49 CFR PART 395

A property-carrying driver may drive at most 11 hours after 10 consecutive hours off, within a 14-hour window, with a 30-minute break after 8 hours of driving, and no more than 60 hours in 7 days or 70 in 8 (49 CFR Part 395). Those hours are recorded by an electronic logging device. On an I-15 run between the Los Angeles basin and Las Vegas, a driver who is over hours is a fatigue case — if the logs are preserved. We demand them in writing before they are overwritten.

CALIFORNIA COMMERCIAL VEHICLE LAW — VEH. CODE §§ 34500 AND 22406

The CHP inspects commercial vehicles and carriers under Veh. Code § 34500, and trucks with three or more axles or towing a trailer are limited to 55 mph on California highways (Veh. Code § 22406). CHP inspection reports, the carrier’s safety rating and the post-crash inspection of the truck all become evidence in the civil case.

FAULT — CIVIL CODE § 1714 AND LI v. YELLOW CAB CO.

Everyone is responsible for harm caused by their lack of ordinary care (Civil Code § 1714). California uses pure comparative negligence (Li v. Yellow Cab Co. (1975) 13 Cal.3d 804): a jury assigns each person a percentage of fault and reduces the award by that percentage, with no cutoff. If you were 20% at fault for a $200,000 loss, you still recover $160,000. Insurers use this rule to shave claims, which is why the evidence of what the other party did matters so much.

DEADLINES — CCP § 335.1, CCP § 338, GOV. CODE § 911.2

You have two years from the date of injury to file a personal injury lawsuit in California (Code Civ. Proc. § 335.1) and three years for property damage (CCP § 338). If a public entity is involved — a city, San Bernardino County, Caltrans or a transit agency — you must first present a government claim within six months (Gov. Code § 911.2). Miss the deadline and the claim is gone, no matter how strong it is.

INSURANCE — SB 1107 MINIMUMS AND INS. CODE § 11580.2

Since January 1, 2025 the minimum California auto policy pays only $30,000 per person, $60,000 per accident and $15,000 for property damage (Veh. Code § 16056, as amended by SB 1107). A serious injury exceeds that in days. Your own uninsured/underinsured motorist coverage (Ins. Code § 11580.2) steps in when the at-fault driver has no insurance, too little, or leaves the scene. We read every policy in the household before we tell you what the claim is worth.

What to Do After a Truck Accident in Hesperia

Seven steps that protect your case

  1. Get medical care the same day, even if you think you are fine. Adrenaline hides injuries, and a gap between the crash and the first visit is the first thing an adjuster uses against you.
  2. Call 911 and get the report number. Crashes on the I-15, US-395 and the state routes are handled by the CHP Victorville Area office; crashes on city streets by San Bernardino County Sheriff’s Department, Hesperia Station.
  3. Photograph the truck — the cab, the trailer, the DOT and carrier numbers on the door, the license plates, the tires and the load — plus the road, the debris field and your injuries. Get the driver’s name, employer and insurance, and the names and phone numbers of witnesses.
  4. Do not give a recorded statement to the other side’s insurer, and do not post about the crash on social media. You are not required to give a statement, and anything you say is used to reduce the claim.
  5. Do not sign anything from the trucking company or its insurer. Their adjusters often arrive at the hospital with a release and a check; the amount is never close to the value of a serious truck injury.
  6. Keep every bill, pharmacy receipt, work note and invoice, and write down what you remember of the crash while it is fresh — the time, the weather, what the other driver said.
  7. Call Beverly Law before you accept any offer. The first offer arrives before anyone knows the full extent of the injury, and accepting it closes the claim permanently. A free consultation costs nothing; no attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement.

How Beverly Law Handles Hesperia Truck Accidents

Our approach and the attorney

Truck claims are fought against a carrier, its insurer and sometimes a rapid-response team that reached the scene before the tow truck. We answer with our own investigation: a preservation demand for the electronic logging device data, dash-cam and telematics, the driver qualification file, the post-crash inspection and the carrier’s maintenance records; a reconstruction of the crash on the I-15, US-395 or the surface street where it happened; and a claim against every responsible company — driver, carrier, broker, shipper or maintenance contractor.

The attorney. Cases are handled under Michael Shemtoub, Esq., California State Bar #253948, admitted in 2007 (UC Hastings College of the Law, 2006). He worked for a federal judge and as a corporate attorney before founding Beverly Law in 2008, was named a Rising Star by Super Lawyers in 2015, 2016 and 2017, and holds a 10.0 “Superb” Avvo rating. The firm has 4.8 stars from 600+ Google reviews.

Process, timeline, fees and results

How a case moves. Free consultation by phone, video or in person. We sign a written contingency agreement, then open the claims, get the collision report and medical records, and tell you honestly what the case is worth once treatment is far enough along. Most claims settle with the insurer; if they do not, we file in the Victorville courthouse of the San Bernardino County Superior Court (14455 Civic Drive, Victorville, CA 92392) and prepare for trial. A straightforward claim can resolve in months; a litigated case in San Bernardino County commonly takes one to two years. Pre-settlement funding is possible in some cases. We help with the vehicle repair and rental, talk to your doctors about treating on a lien, and return calls in English or Spanish.

Fees. No attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement. The percentage is agreed in writing before we start.

Results. On its About page the firm reports a $2,500,000 settlement after an initial offer of $100,000, and Lyft and Uber accident settlements after initial offers of $60,000 and $30,000. Results vary. Past results do not guarantee a similar outcome.

Hesperia Truck Accident FAQ

How much is a truck accident case worth in Hesperia?

More than a car claim with the same injury, because carriers carry larger policies (federal rules require at least $750,000 for most interstate carriers, and many carry $1–5 million) and because several companies may be liable. The value depends on the injury, the treatment record, lost income, how clear fault is and how much coverage exists. Any lawyer who quotes a number before reading the file is guessing.

Who can be held responsible for a truck accident?

The driver, the motor carrier that employs or leases them, the owner of the tractor or trailer, the company that loaded the cargo, a maintenance contractor, and sometimes the broker or shipper. Each has its own insurance. Identifying all of them early is the difference between a $30,000 policy and a $1,000,000 one.

Do I have to go to court for a Hesperia truck accident claim?

Usually not. Most claims settle with the insurer before a lawsuit is filed, and most filed cases settle before trial. If the insurer will not pay what the case is worth, we file in the Victorville courthouse of the San Bernardino County Superior Court and prepare for trial. You would attend a deposition and, if it goes that far, the trial — we prepare you for both.

Can I still claim if I was partly at fault?

Yes. California uses pure comparative negligence: your recovery is reduced by your percentage of fault, but it is never cut off. The insurer will try to assign you a high percentage; the evidence we collect is what keeps that number honest.

How long does a truck accident case take?

A claim with a clear liability picture and finished treatment can resolve in a few months. Truck cases take longer because there is more evidence to obtain and more defendants, and a litigated case in San Bernardino County commonly takes one to two years. The deadline to file is two years from the injury (six months to present a claim against a public entity), and we calendar it the day you hire us.

Do you handle cases in Spanish?

Yes. Beverly Law works in English and Spanish. You can call, text or WhatsApp us in Spanish, your meetings and documents are explained in Spanish if you prefer, and this page has a Spanish version: Abogado de accidentes en Hesperia (español) →
