What the Law Says
California Vehicle Code 20001 makes it a crime for a driver involved in a crash that causes injury or death to leave the scene without stopping. Depending on the severity of the injury, a violation can be charged as a misdemeanor or a felony, as authorities allege happened here. The law exists precisely to prevent situations like this one, where a fleeing driver delays medical care and hampers the investigation. Prosecutors can also pursue enhanced penalties when a victim dies as a result of the collision.
California Vehicle Code 20003 requires a driver involved in an injury or fatal crash to provide their name, address and vehicle registration, and to render reasonable assistance to anyone injured. A driver who flees, as authorities allege happened in this case, fails that duty. Evidence such as surveillance footage and automated license plate reader data, as investigators used here, is often what allows police to identify a driver who did not stop. Civil claims over the victim’s injuries and death can proceed separately from any criminal case against the driver.
