If a vehicle hit you while you were walking, crossing or waiting at a bus stop in Victorville, get medical care the same day and do not accept a quick offer from the driver’s insurer. Beverly Law gets the collision report, finds the camera footage before it is overwritten, works out which coverage applies — the driver’s, your own household auto policy, or both — and handles every call with the insurance companies.

Our office is in Los Angeles (4929 Wilshire Blvd, Suite 960, Los Angeles, CA 90010). We represent Victorville clients by phone, video and in-person meetings by appointment, and a Victorville lawsuit is filed in the Victorville courthouse of the San Bernardino County Superior Court (14455 Civic Drive, Victorville, CA 92392), a few minutes from the crash sites on this page. Free consultation, 24/7, in English and Spanish. No attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement.

Why Pedestrian Accidents Happen in Victorville

The streets, the crossings and the numbers

Victorville pedestrians walk Seventh Street and Old Town, the bus stops along Bear Valley Road and Palmdale Road, the shopping centers at Roy Rogers Drive and Amargosa Road, and residential arterials like La Mesa Road and Ridgecrest Road that have few signalized crosswalks and long dark stretches. Mid-block crossings on six-lane roads, drivers turning right on red without looking for people in the crosswalk, and night crashes near the I-15 ramps are the recurring causes.

In September 2026 a pedestrian was struck by a Tesla on La Mesa Road in Victorville and seriously injured — one of the firm’s recent local stories — and in neighboring Adelanto a man was killed by a box truck on Air Expressway and a pedestrian was struck and killed on Highway 395 south of Seneca Road. In the 2023 OTS rankings Victorville reported 23 pedestrian crash victims, including children and seniors. Insurers routinely argue that a person crossing outside a crosswalk was at fault; California law and the facts usually say otherwise.

Where you are treated and where the case is filed both matter. Victorville has two emergency rooms — Victor Valley Global Medical Center and Desert Valley Hospital — and Providence St. Mary Medical Center is in neighboring Apple Valley, but the nearest trauma centers are down the Cajon Pass: Arrowhead Regional Medical Center in Colton (Level II) and Loma Linda University Medical Center (Level I). That is why so many serious Victorville crashes end with a helicopter. If the claim does not settle, the lawsuit is filed in the Victorville courthouse of the San Bernardino County Superior Court (14455 Civic Drive, Victorville, CA 92392), a few minutes from the crash sites on this page; injury cases from across the Victor Valley are heard there.

What the numbers say

Office of Traffic Safety, 2023 rankings (Victorville, Group B, 62 comparable cities; 1 = worst): 452 people killed or injured in crashes (rank 51); 64 alcohol-involved victims (rank 31); 33 motorcycle victims (rank 31); 23 pedestrian victims (rank 52); 89 speed-related crashes (rank 29); 44 nighttime crashes (rank 47); 25 hit-and-run crashes (rank 54); 105 DUI arrests (rank 8). What California Law Says About Pedestrian Accidents

RIGHT OF WAY IN CROSSWALKS — VEH. CODE § 21950

A driver must yield to a pedestrian in any crosswalk, marked or unmarked — and every intersection has an unmarked crosswalk unless signs say otherwise (Veh. Code § 21950). The law also tells drivers to slow down and take whatever care is needed to protect a person on foot. A driver turning right on red through a crosswalk on Seventh Street or Bear Valley Road has the duty, not the pedestrian.

OUTSIDE A CROSSWALK — VEH. CODE §§ 21954 AND 21955

A pedestrian crossing mid-block must yield to vehicles (Veh. Code § 21954), but the same section says the driver still must exercise due care. Since 2023, crossing outside a crosswalk is not a ticket unless there is an immediate danger of a collision (Veh. Code § 21955). Being hit mid-block is not the end of a claim; it is a comparative-fault argument we answer with speed, lighting and sight-line evidence.

FAULT — CIVIL CODE § 1714 AND LI v. YELLOW CAB CO.

Everyone is responsible for harm caused by their lack of ordinary care (Civil Code § 1714). California uses pure comparative negligence (Li v. Yellow Cab Co. (1975) 13 Cal.3d 804): a jury assigns each person a percentage of fault and reduces the award by that percentage, with no cutoff. If you were 20% at fault for a $200,000 loss, you still recover $160,000. Insurers use this rule to shave claims, which is why the evidence of what the other party did matters so much.

DEADLINES — CCP § 335.1, CCP § 338, GOV. CODE § 911.2

You have two years from the date of injury to file a personal injury lawsuit in California (Code Civ. Proc. § 335.1) and three years for property damage (CCP § 338). If a public entity is involved — a city, San Bernardino County, Caltrans or a transit agency — you must first present a government claim within six months (Gov. Code § 911.2). Miss the deadline and the claim is gone, no matter how strong it is.

HIT AND RUN — VEH. CODE §§ 20001 AND 20002

A driver who leaves the scene of an injury crash commits a felony (Veh. Code § 20001). If the driver is never found, your own uninsured motorist coverage usually pays the claim; if they are found, their flight is strong evidence of fault. Report a hit-and-run to the police immediately and tell your own insurer within the time your policy requires.

WHO PAYS — INS. CODE § 11580.2 AND SB 1107

The driver’s liability policy pays first, and since January 1, 2025 the minimum is only $30,000 per person (Veh. Code § 16056). When that is not enough, or the driver fled, the uninsured/underinsured motorist coverage on your own or a family member’s auto policy covers you even though you were on foot (Ins. Code § 11580.2). Many pedestrians never learn this unless a lawyer asks about the household policies.

What to Do After a Pedestrian Accident in Victorville

Seven steps that protect your case

  1. Get medical care the same day, even if you think you are fine. Adrenaline hides injuries, and a gap between the crash and the first visit is the first thing an adjuster uses against you.
  2. Call 911 and get the report number. Crashes on the I-15, US-395 and the state routes are handled by the CHP Victorville Area office; crashes on city streets by San Bernardino County Sheriff’s Department, Victorville Station.
  3. Photograph the vehicle and its plate, the crosswalk or the spot where you were hit, the signals, the lighting, your injuries and your clothing. Get the driver’s license, registration and insurance, and the names and numbers of witnesses. Look for businesses or homes with cameras facing the street.
  4. Do not give a recorded statement to the other side’s insurer, and do not post about the crash on social media. You are not required to give a statement, and anything you say is used to reduce the claim.
  5. Report the crash to your own auto insurer if you or anyone in your household has a policy. Uninsured and underinsured motorist coverage follows the person, not the car, and it is often the only real source of recovery when the driver is uninsured or fled.
  6. Keep every bill, pharmacy receipt, work note and invoice, and write down what you remember of the crash while it is fresh — the time, the weather, what the other driver said.
  7. Call Beverly Law before you accept any offer. The first offer arrives before anyone knows the full extent of the injury, and accepting it closes the claim permanently. A free consultation costs nothing; no attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement.

How Beverly Law Handles Victorville Pedestrian Accidents

Our approach and the attorney

Pedestrian claims turn on evidence that disappears fast: business and doorbell camera footage, skid marks, the driver’s phone records and the lighting at the scene. We send investigators and preservation letters early, document the injury with providers who treat on a lien, and look for every policy that applies — the driver’s, the vehicle owner’s, an employer’s if the driver was working, and the uninsured motorist coverage in your own household. Our team includes former insurance adjusters who know how the other side values these cases.

The attorney. Cases are handled under Michael Shemtoub, Esq., California State Bar #253948, admitted in 2007 (UC Hastings College of the Law, 2006). He worked for a federal judge and as a corporate attorney before founding Beverly Law in 2008, was named a Rising Star by Super Lawyers in 2015, 2016 and 2017, and holds a 10.0 “Superb” Avvo rating. The firm has 4.8 stars from 600+ Google reviews.

Process, timeline, fees and results

How a case moves. Free consultation by phone, video or in person. We sign a written contingency agreement, then open the claims, get the collision report and medical records, and tell you honestly what the case is worth once treatment is far enough along. Most claims settle with the insurer; if they do not, we file in the Victorville courthouse of the San Bernardino County Superior Court (14455 Civic Drive, Victorville, CA 92392), a few minutes from the crash sites on this page and prepare for trial. A straightforward claim can resolve in months; a litigated case in San Bernardino County commonly takes one to two years. Pre-settlement funding is possible in some cases. We talk to your doctors about treating on a lien, and return calls in English or Spanish.

Fees. No attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement. The percentage is agreed in writing before we start.

Results. On its About page the firm reports a $2,500,000 settlement after an initial offer of $100,000, and Lyft and Uber accident settlements after initial offers of $60,000 and $30,000. Results vary. Past results do not guarantee a similar outcome.

Victorville Pedestrian Accident FAQ

How much is a pedestrian accident case worth in Victorville?

Pedestrian injuries are usually severe because there is nothing between you and the vehicle. Value depends on the injury, the treatment record, lost income, the fault argument the insurer makes (crosswalk, lighting, clothing) and the coverage available — the driver’s policy and the uninsured/underinsured coverage in your own household. Any lawyer who quotes a number before reading the file is guessing.

I was hit outside a crosswalk. Can I still recover?

Yes. Crossing mid-block may give the insurer a comparative-fault argument, but the driver still had a duty to see you and avoid you (Veh. Code § 21954), and since 2023 crossing outside a crosswalk is not even a citation unless there was an immediate danger. Speed, lighting, distraction and sight lines decide these cases.

Do I have to go to court for a Victorville pedestrian accident claim?

Usually not. Most claims settle with the insurer before a lawsuit is filed, and most filed cases settle before trial. If the insurer will not pay what the case is worth, we file in the Victorville courthouse of the San Bernardino County Superior Court and prepare for trial. You would attend a deposition and, if it goes that far, the trial — we prepare you for both.

Can I still claim if I was partly at fault?

Yes. California uses pure comparative negligence: your recovery is reduced by your percentage of fault, but it is never cut off. The insurer will try to assign you a high percentage; the evidence we collect is what keeps that number honest.

How long does a pedestrian accident case take?

A claim with a clear liability picture and finished treatment can resolve in a few months. A litigated case in San Bernardino County commonly takes one to two years. The deadline to file is two years from the injury (six months to present a claim against a public entity), and we calendar it the day you hire us.

Do you handle cases in Spanish?

Yes. Beverly Law works in English and Spanish. You can call, text or WhatsApp us in Spanish, your meetings and documents are explained in Spanish if you prefer, and this page has a Spanish version: Abogado de accidentes en Victorville (español) →
