A 21-year-old Amarillo man was killed Friday afternoon when his pickup truck collided with a tractor-trailer at the intersection of U.S. Highway 287 and FM 1912 in Potter County, just outside Amarillo, Texas. The tractor-trailer had reportedly been crossing the highway to turn onto U.S. 287 South when the pickup, traveling west, struck the trailer. The pickup driver was pronounced dead at the scene, while the truck driver was not injured. Part of U.S. 287 was shut down for several hours as crews worked the crash, with traffic rerouted onto Interstate 40.

According to ABC7 Amarillo (KVII-TV), the pickup driver has been identified as Ryan Lane Simpson, 21, of Amarillo, and the tractor-trailer driver as Juan Carlos Sanchez, 47, also of Amarillo; both were reportedly wearing seat belts. Texas Department of Public Safety Sergeant Cindy Barkley told NewsChannel 10 that the collision proved fatal for the pickup’s driver and that Texas Highway Patrol troopers are continuing to investigate exactly how the crash occurred. No citations had been announced as of the latest reports. Crashes involving commercial trucks and passenger vehicles at rural highway intersections like this one often raise questions about right-of-way and visibility that investigators will need to sort out.

What the Law Says

Texas Transportation Code Section 545.151 sets out right-of-way rules for vehicles approaching or entering an intersection, requiring drivers to yield to traffic that already has the right of way before crossing or turning onto a highway. When a truck crosses a busy highway like U.S. 287 to reposition itself, the driver must make sure the crossing can be completed safely before pulling into the path of oncoming traffic. Investigators looking into this crash will likely examine whether the tractor-trailer had sufficient clearance to cross when the pickup was approaching.

Because the crash resulted in a fatality, Texas Civil Practice and Remedies Code Section 71.002 allows the surviving family members of the pickup driver to pursue a wrongful death claim against those whose negligence contributed to the crash. The statute permits recovery for losses such as lost financial support, loss of companionship, and mental anguish suffered by the surviving spouse, children, or parents of the person killed. Any such claim would need to establish that a driver’s negligence, such as failing to yield the right of way, caused the fatal collision.
