A 27-year-old Ventura man suffered major injuries late Monday night after being ejected from his vehicle in a single-car crash on Olivas Park Drive. The California Highway Patrol responded to the scene east of Palma Drive around 11:49 p.m. on Monday, Sept. 14, and found a tan Infiniti G20 on its side roughly 50 feet from the roadway. The man was found injured on the ground near the vehicle and was rushed to Ventura County Medical Center for treatment. Investigators say the driver was headed eastbound when he made an unsafe turning motion, left the roadway and struck a fence before being thrown from the car.
According to the Ventura County Star, the crash remains under investigation by the California Highway Patrol, which said in a news release that the driver was arrested on suspicion of driving under the combined influence of drugs and alcohol. News Channel 3-12 (KEYT) reported that CHP is asking anyone with information about the crash to call the Ventura Office at 805-662-2640. No road closures were reported in connection with the collision. Authorities have not released the driver’s name.
California Vehicle Code 23152 makes it illegal to drive a vehicle while under the influence of alcohol, drugs, or a combination of both. A driver can be charged under this statute when impairment is shown to have affected their ability to operate the vehicle safely, regardless of the specific substance involved. Penalties escalate sharply when a DUI crash causes injury, and a conviction can support a civil claim for the injured party’s medical expenses and other losses.
California Vehicle Code 22107 requires drivers to signal before turning and prohibits any turning movement that cannot be made with reasonable safety to other traffic. When a driver leaves a marked lane or the roadway without first ensuring the movement is safe, as CHP alleges happened in this crash, they may be found negligent under California law. That negligence can form the basis of a personal injury claim for anyone hurt as a result.
