What the Law Says

California Vehicle Code section 21950 requires drivers to yield the right-of-way to pedestrians crossing at a crosswalk and to use due care for their safety. Drivers must also exercise caution around pedestrians generally. A driver who allegedly fails to do so may be held responsible for the harm caused.

California Vehicle Code section 22350, the basic speed law, prohibits driving faster than is reasonable for conditions, regardless of the posted limit. Under California Code of Civil Procedure section 377.60, certain family members may bring a wrongful death claim when a loved one is killed by another’s wrongful act or neglect.
