What the Law Says
California’s Basic Speed Law, Vehicle Code 22350, prohibits driving at a speed greater than is reasonable or prudent given the weather, visibility, traffic, and roadway conditions, even if that speed is below the posted limit. Investigators examining a single-vehicle crash into a center divider often look at whether speed, fatigue, or reduced visibility during early-morning hours played a role in the loss of control. A violation of this statute can support a finding of negligence in a subsequent injury or wrongful death claim.
California Government Code Section 835 allows an injured party to hold a public entity like Caltrans liable when a dangerous condition of public property, such as an inadequate median barrier or poor roadway design, contributes to a crash. Claims against a public entity require a formal government claim to be filed within strict, short deadlines. An attorney can help evaluate whether the freeway’s design or maintenance played a role in this crash.
