Pedestrian fatally struck on Rosedale Highway identified as Bakersfield woman
California Vehicle Code section 21954 says a pedestrian outside a crosswalk must yield to vehicles, but it also states this does not relieve a driver of the duty to exercise due care for the safety of any pedestrian on the roadway. Whether a driver used due care is a fact question that depends on speed, lighting, attention and visibility.
California Code of Civil Procedure section 377.60 lets certain surviving family members, and others who qualify, bring a wrongful death claim when a person dies because of another’s wrongful act or neglect. California also applies comparative fault, so any share of responsibility assigned to a pedestrian can reduce a recovery rather than automatically bar it.
