A man riding a bicycle was killed early Friday, September 4, 2026, in a collision at Trimble Road and North First Street in North San Jose. San Jose police were called to the intersection at about 4:20 a.m. and found an adult man unconscious and not breathing in the roadway. He was pronounced dead at the scene, and authorities have not publicly released his name. The San Jose Police Department is handling the investigation, which remains open.

According to NBC Bay Area, a preliminary investigation found that a man driving a gray 2024 Toyota Corolla was heading west on Trimble Road with a green light when he allegedly struck the bicyclist, who was traveling north on North First Street in the crosswalk. Police told the outlet that the driver remained at the scene and cooperated with investigators, and that drugs and alcohol do not appear to have been factors. NBC Bay Area reported that the death is San Jose’s 33rd fatal collision and 33rd traffic-related death of 2026. Hoodline reported that several streets around the intersection were closed while investigators documented the scene, and that this was the second fatal bicycle collision in the city in about 24 hours.

What the Law Says

California Vehicle Code 21950 requires a driver to yield the right of way to a person crossing within a marked or unmarked crosswalk at an intersection. The same section tells drivers to exercise all due care, reduce speed, and take whatever action is needed to protect the safety of people in the crosswalk. Investigators in a case like this typically examine signal timing, sight lines, and vehicle speed to determine whether that duty of care was met. Nothing about this crash has been formally decided, and no fault has been assigned.

California Vehicle Code 21200 gives a person riding a bicycle on a public roadway all of the rights and all of the duties that apply to the driver of a vehicle. That means a bicyclist is a legitimate road user whose right of way must be respected, and it also means the rider is bound by the same rules of the road. In a collision between a car and a bicycle, investigators apply this section to both parties when reconstructing who had the right of way. The San Jose Police Department has not stated any conclusion about right of way in this case.
