A pedestrian has died after being struck by an SUV on Blossom Hill Road in San Jose, California. San Jose police say the crash happened the night of Thursday, September 1, 2026, at the intersection with Thornwood Drive, when a 2005 Acura SUV traveling eastbound struck a man who was crossing the street. The man was rushed to a hospital with life-threatening injuries and appeared to stabilize, but he died six days later, on August 19, 2026. The driver stayed at the scene and cooperated with investigators, and no arrests have been reported.

According to the San Jose Police Department, the collision marked the city’s 29th fatal traffic collision and 15th pedestrian death of 2026, reflecting an ongoing rise in pedestrian deaths across San Jose this year. The San Francisco Chronicle, which also reported on the case, said the pedestrian was crossing southbound on Blossom Hill Road, just west of Thornwood Drive, when the SUV struck him. SJPD’s Traffic Investigations Unit is continuing to investigate the crash and has asked anyone with information to come forward. Police have not released the pedestrian’s name, and no citations or arrests had been announced as of this report.

What the Law Says

California Vehicle Code Section 21950 requires drivers to exercise due care and yield the right-of-way to pedestrians crossing within a marked or unmarked crosswalk. This duty applies regardless of traffic signals, and a driver’s failure to slow down or stop for a pedestrian can support a civil claim for damages. Investigators in fatal pedestrian collisions like this one routinely examine whether the driver had a clear line of sight and enough time to react.

Vehicle Code Section 21954 states that a pedestrian crossing outside of a marked crosswalk must yield to approaching vehicles, but it does not excuse a driver from the duty to exercise ordinary care to avoid colliding with any pedestrian on the roadway. Fault in these cases is often shared and depends on factors like vehicle speed, lighting conditions, and whether the driver was distracted. An attorney can help evaluate how California’s comparative negligence rules may apply to a specific crash.
