What the Law Says
California Vehicle Code Section 21650 requires drivers to keep to the right half of the roadway except when passing, turning left, or in other specified situations. A witness in this crash reported that a vehicle allegedly crossed into oncoming traffic before colliding with the victim’s car. A violation of this statute can serve as evidence of negligence in a civil claim following a wrong-way or head-on collision. Investigators will need to determine which driver, if any, violated the right-of-way rule.
California Code of Civil Procedure Section 377.60 allows certain surviving family members, such as a spouse, children, or other dependents, to bring a wrongful death claim when a loved one is killed due to another party’s negligence. In a fatal crash like this one, the victim’s family may be entitled to compensation for funeral expenses, lost financial support, and loss of companionship. The statute defines who qualifies to file such a claim and what damages may be recovered. An attorney can help a family understand their rights under this law.
