If a truck hit you in or around Moorpark, get medical care today, get the CHP or Moorpark Police report number, and do not talk to the trucking company’s insurer before you talk to a lawyer — carriers send investigators to the scene the same day. Beverly Law’s Moorpark truck accident attorneys preserve the truck’s electronic logs and camera footage, identify every company that shares liability and deal with the insurers so you can recover.

Trucks are a daily fact of life on the 118: agricultural trucks from the Santa Rosa and Las Posas valleys, delivery and freight traffic between the 23, the 101 and Simi Valley, and big rigs that come straight through town on Los Angeles Avenue. A crash with an 80,000-pound truck at freeway speed is rarely minor, and the carrier’s insurer starts building its defense within hours.

Beverly Law’s office is at 4929 Wilshire Blvd, Suite 960, Los Angeles, CA 90010, about 45 miles from Moorpark via the 118 and the 405. We represent Moorpark and Ventura County clients by phone, video and WhatsApp, and we meet in person in Ventura County by appointment; most clients never need to drive to Los Angeles. Call 1 (877) 427-2752 (24/7) or message us on WhatsApp in English or Spanish.

Why Truck Crashes Happen Around Moorpark

The 118 corridor and the roads that feed it

SR-118 (the Ronald Reagan Freeway) is the trucking route between the San Fernando Valley, Simi Valley and the farms and packing houses of Ventura County; west of the 23 it drops to a surface street — Los Angeles Avenue — with signals, driveways and left turns, which is where trucks meet local traffic. SR-23 adds the freight headed to and from the 101 in Thousand Oaks. The most common patterns we see: rear-end crashes where the 118 slows into town, unsafe lane changes into a truck’s blind spot near the 118/23 interchange, wide right turns at Los Angeles Avenue intersections, and trucks on two-lane roads like Grimes Canyon and Broadway with no room to recover from a mistake.

Moorpark is a small city, and its numbers are small: the California Office of Traffic Safety counted 82 people killed or injured in Moorpark crashes in 2023, ranking it 69th of 93 California cities of similar size, where 1st is the worst. Its one weak spot is speed — 18 speed-related injury crashes put it 34th of 93, in the worse half of the group — along with 6 motorcyclist victims and 81 DUI arrests in the year (OTS Crash Rankings, 2023). The serious crashes around Moorpark tend to happen on the fast roads at its edges: SR-118, SR-23, Grimes Canyon Road and Los Angeles Avenue.

Driver fatigue, speed and maintenance show up again and again in truck cases. Each is a federal violation — and evidence.

Where the injured are treated — and where the case is filed

The most serious injuries go to Ventura County Medical Center in Ventura or Los Robles Regional Medical Center in Thousand Oaks — both Level II trauma centers about 20 to 30 minutes from Moorpark. If a lawsuit is needed it is filed in the Ventura County Superior Court, Hall of Justice, 800 South Victoria Avenue, Ventura, CA 93009.

Moorpark contracts its policing to the Ventura County Sheriff’s Office (Moorpark Police Department), which writes the report for crashes on city streets. On SR-118, SR-23 and the unincorporated roads around the city — Grimes Canyon Road, Broadway Road, the stretch of Los Angeles Avenue outside city limits — the report comes from the CHP Moorpark Area office. We pull the report for our clients at no cost.

What California and Federal Law Say About Truck Accidents

Hours of service and electronic logs — 49 CFR Part 395

Federal rules limit a property-carrying driver to 11 hours of driving inside a 14-hour window, require a 30-minute break after 8 hours, and cap the week at 60 or 70 hours. Those hours are recorded on an electronic logging device (ELD). A driver who was over hours when he hit you was breaking the law, and the ELD proves it — but carriers only have to keep the data for six months, which is why we send a preservation letter immediately. Read 49 CFR Part 395

The carrier is responsible too — 49 CFR Part 390 and following

The Federal Motor Carrier Safety Regulations (49 CFR § 390 et seq.) make the trucking company responsible for hiring qualified drivers, checking their driving and drug-test history, inspecting and maintaining the truck and keeping the records that prove it. Interstate carriers must also carry far more liability insurance than a private driver — at least $750,000 for most freight (49 CFR § 387.9). A Moorpark truck case can involve the driver, the carrier, the owner of the trailer, the grower or shipper who loaded it and the shop that serviced the brakes. Read 49 CFR Part 390

Negligence and shared fault — Civil Code § 1714 and Li v. Yellow Cab

Under Civil Code § 1714 everyone is responsible for injuries caused by their lack of ordinary care, and an employer is responsible for an employee driving on the job. California applies pure comparative negligence (Li v. Yellow Cab Co. (1975) 13 Cal.3d 804): if a jury finds you 20% at fault, you still recover 80% of your damages. Trucking insurers push hard to shift blame to the car driver; the ELD, dashcam and physical evidence usually tell a different story.

Deadlines — CCP § 335.1, § 338 and Gov. Code § 911.2

You have two years from the crash to file an injury lawsuit (CCP § 335.1) and three years for property damage (CCP § 338). If the truck belonged to a public agency — a Ventura County or City of Moorpark vehicle, a Caltrans truck — or a road defect on the 118 or 23 contributed, a government claim must be presented within six months (Gov. Code § 911.2). That is the deadline people miss.

Impaired and distracted truck drivers — Vehicle Code §§ 23152, 23123.5

DUI (Veh. Code § 23152) and handheld phone use (Veh. Code § 23123.5) are both negligence per se, and commercial drivers are held to a 0.04% blood-alcohol limit. When a driver was drunk, California allows punitive damages on top of compensation (Taylor v. Superior Court (1979) 24 Cal.3d 890), which no insurance policy covers.

Insurance minimums and your own UM/UIM coverage

Since January 1, 2025 the minimum auto policy in California is $30,000 per person / $60,000 per accident / $15,000 property damage (SB 1107). If the at-fault vehicle was a small local truck with a minimum policy, or a hit-and-run, your own uninsured/underinsured motorist coverage (Ins. Code § 11580.2) may be the real source of recovery. We check every policy that could apply.

What to Do After a Truck Accident in Moorpark

Eight steps that protect your truck case

  1. Call 911 and get checked the same day, even if you feel fine — internal injuries and concussions often show up hours later. Keep every discharge paper.
  2. Get the report number. On the 118, the 23 and county roads like Grimes Canyon the CHP Moorpark Area office writes the report; on city streets it is the Ventura County Sheriff’s Moorpark Police Department.
  3. Photograph the truck’s cab, trailer, the USDOT and CA numbers on the door, both license plates, the carrier’s name, skid marks, debris and your own vehicle and injuries.
  4. Get names and phone numbers of witnesses and note nearby businesses or farms that may have camera footage.
  5. Do not talk to the carrier’s investigator or insurer, do not give a recorded statement and do not sign a medical release.
  6. Have your lawyer send a preservation letter right away for the ELD data, dashcam video, driver qualification file, drug-test results and maintenance records.
  7. File the SR-1 with the DMV within 10 days (Veh. Code § 16000) and notify your own insurer that a crash happened — without giving an opinion on fault.
  8. Call Beverly Law before accepting any offer. The trucking insurer’s first number is built on incomplete medical information.

If a loved one died in a truck crash, the family has two years from the date of death to file a wrongful-death claim; the same preservation steps apply and should start immediately.

How Beverly Law Handles Moorpark Truck Accident Cases

We deal with the insurer so you are not pushed into a lowball offer

The first offer arrives before anyone knows how badly you are hurt, and signing it ends the claim. Our team includes former insurance adjusters who know how carriers value Ventura County truck accident claims and what they leave out. We take every call from the insurance company so you never have to.

In truck cases we also retain the experts the carrier’s insurer expects — accident reconstruction, trucking-safety and medical — so the demand is built on the truck’s own data, not on the driver’s version.

What we do in the first two weeks

  • Order the Moorpark Police (Ventura County Sheriff) or CHP report and your 911 records.
  • Send preservation letters for video, vehicle data and documents before they are erased.
  • Help you get your vehicle repaired or valued, and a rental where coverage allows.
  • Refer you to doctors and specialists in Ventura County who treat on a lien, so care does not wait for a settlement.
  • In some cases, help arrange pre-settlement funding so bills do not force a bad decision.
  • Open the claim with every insurer that may owe coverage, including your own UM/UIM policy.

Timeline: what to expect

Most Moorpark truck accident claims settle once treatment is finished and a complete demand goes out — often within a few months. If the insurer will not pay what the case is worth, we file in Ventura County Superior Court; litigated cases commonly take one to two years and most still settle before trial.

Deadlines run from the day of the crash: two years for injury (CCP § 335.1) and only six months to present a government claim if the City of Moorpark, Ventura County, Caltrans or a road defect is involved (Gov. Code § 911.2).

Fees, results and who reviews your case

No attorney fee unless we win. Whether case costs are deducted from a recovery is explained in your written fee agreement. Everything is explained in writing before we start.

Results shown on our About page include a $2,500,000 settlement after an initial offer of $100,000, and Lyft and Uber accident settlements after initial offers of $60,000 and $30,000. Results vary. Past results do not guarantee a similar outcome.

Moorpark Truck Accident FAQ

How much is a truck accident case worth in Moorpark?

There is no formula. The value depends on the injuries and whether they are permanent, your medical bills and future care, lost income, how clear fault is and — often the real ceiling — how much insurance exists. Truck cases tend to be worth more than car cases because the injuries are more severe and the carrier’s policy is larger (federal rules require at least $750,000 for most interstate freight). Any lawyer who quotes a number before reading the police report and your medical records is guessing.

Who can be held responsible for a truck crash near Moorpark?

Potentially the driver, the motor carrier that employed or leased him, the owner of the tractor or trailer, the grower or shipper that loaded the cargo, the maintenance contractor, and — if a public vehicle or a road defect was involved — a city, county or state agency. Identifying every party early matters because each one has its own insurer and its own deadline.

Do I have to go to court?

Usually not. Most Moorpark truck accident claims settle with the insurer before a lawsuit is filed, and most filed cases settle before trial. If a lawsuit is needed it is filed at the Ventura County Superior Court’s Hall of Justice, 800 South Victoria Avenue in Ventura, and we handle every hearing. You would only testify at a deposition or trial, and we prepare you for both.

Can I still claim if I was partly at fault?

Yes. California follows pure comparative negligence (Li v. Yellow Cab Co., 1975). Your recovery is reduced by your percentage of fault but never eliminated — a person found 40% at fault still recovers 60% of their damages. Insurers routinely inflate the victim’s share, which is one reason not to give a recorded statement.

How long does a case take?

A claim with clear fault and finished treatment can settle in three to six months. Serious injuries, disputed fault or several insurers take longer, and a case filed in Ventura County Superior Court commonly takes one to two years. We do not rush a settlement before your doctors know whether you will need future care.

Do you handle cases in Spanish?

Yes. Beverly Law’s intake team, case managers and attorneys work in Spanish and English every day. Calls, texts, WhatsApp and documents can all be in Spanish, and this page has a Spanish version (the ES button at the top).

Where is your office? Do I have to come to Los Angeles?

Our office is at 4929 Wilshire Blvd, Suite 960, Los Angeles, CA 90010, about 45 miles from Moorpark. We serve Moorpark and Ventura County clients by phone, video and WhatsApp and meet in person in Ventura County by appointment; most clients never need to come to Los Angeles.
