January 2025: Class A citation and F600 (severity G) after a nursing assistant sexually assaulted a resident during care

CDPH made an unannounced visit on November 26, 2024, to investigate one complaint and two facility-reported incidents of sexual abuse. According to the citation, at about 8 p.m. on November 23, 2024, CNA 1 inserted his fingers into Resident 1's vagina while changing her brief, then grabbed her right hand and forced her to touch his penis. Resident 1 was a 60-year-old woman with moderate cognitive impairment who depended on staff for toileting and other daily care.

According to the citation, Resident 1's roommate told inspectors that Resident 1 was crying that night and said she did not want CNA 1 in her room again. The next morning Resident 1 told a nursing assistant, a registered nurse and the manager on duty what happened. The manager on duty told inspectors Resident 1 said "no," pushed her hand away and CNA 1 stopped, and that she was scared and in tears. CDPH found the facility failed to protect Resident 1's right to be free from sexual abuse.

According to the citation, Resident 1 was seen agitated, fearful, anxious and crying that night and twice the next morning, and she was sent to a hospital for evaluation on November 24. The director of staff development told inspectors CNA 1 said his finger "slipped," and that she suspended him. CDPH issued a Class A citation with a $25,000 penalty. The federal 2567 report cited F600 at severity G for failing to keep the resident free from abuse.

June 2024: Class A citation, penalty trebled, and F692 (severity G), F609 (severity D) and F610 (severity D) after a resident lost 39 pounds in six months

CDPH made an unannounced visit on April 30, 2024, for a recertification survey. According to the citation, the facility failed to evaluate and change the texture of Resident 103's diet to meet his nutritional needs, and he had an unplanned weight loss of 39 pounds, or 26.35 percent, in six months. Resident 103 was a 62-year-old man with diabetes, high blood pressure, anemia and weakness on one side of the body. He was cognitively intact and could eat with supervision.

According to the citation, his weight records showed him at 148 pounds on admission in November 2023 and 109 pounds on April 30, 2024, with losses the records marked as severe starting in March. His diet orders were changed several times, including to chopped soft food, fortified food and added snacks, before a fortified puree diet (smooth, pudding-like food) was ordered on April 15, 2024.

CDPH found that when inspectors spoke with Resident 103 on April 30, he was lying in bed, could not use his left hand, and said he had a toothache, could not chew the hard vegetables the facility served, and had lost weight. He said he preferred a puree diet because it was easier to eat, and that staff had started offering it only three days earlier. CDPH issued a Class A citation with a $25,000 penalty trebled to $75,000. The 2567 report cited F692 at severity G for nutrition and hydration, plus F609 at severity D (reporting of alleged violations) and F610 at severity D (investigating and correcting alleged violations). The full narrative for those two tags is in the linked report.

November 2023: Class A citation and F600 and F689 (severity J) after a resident at risk for elopement was missing for three days

CDPH made an unannounced visit on October 5, 2023, to investigate a facility-reported incident about a missing resident. According to the citation, Resident 1 was a 56-year-old man with a past traumatic brain bleed and skull fracture and a gastrostomy (feeding tube) who could not make his own decisions, wandered, and was assessed at risk for falls and elopement (leaving without staff knowledge). His physician ordered a wander guard bracelet that sets off door alarms, and his care plan called for one-to-one supervision because he tried to open exit doors.

CDPH found the facility did not supervise him as his care plan required and had no policies on supervising residents who wander or on using wander guards. According to the citation, he left through a door near the kitchen that led to the back parking lot while wearing the bracelet, and staff did not hear an alarm. The administrator told inspectors security cameras only kept footage for 24 hours and could not show inspectors same-day recordings.

According to the citation, Resident 1 was last seen at 6 a.m. on October 4, 2023, and stayed missing until October 7, when he was seen at a hospital emergency room; he returned to the facility on October 8. CDPH issued a Class A citation with a $25,000 penalty. The 2567 report cited F600 and F689 at severity J and states the facility's removal plan included a private investigator, round-the-clock staff at the back exit doors and on camera monitoring, and checks of all wander guards every shift.

What this record means for your family

California uses classes for state citations. Under Health and Safety Code section 1424 ↗, a Class AA citation is a Class A violation that CDPH determined was a direct proximate cause of a resident’s death. A Class A citation means CDPH found an imminent danger, or a substantial probability, that death or serious physical harm would result. Class B covers violations with a direct or immediate relationship to residents’ health, safety or security.

Federal deficiencies carry a letter from A to L. G, H and I mean inspectors found actual harm to residents; J, K and L mean immediate jeopardy, the most serious level. F600 is the federal rule that residents be free from abuse and neglect; F609 and F610 cover reporting and investigating allegations; F689 covers accidents and supervision; F686 covers pressure injuries.

Warning signs worth asking about: unexplained bruises or fractures, new bed sores, sudden weight loss or dehydration, a resident who becomes fearful or withdrawn around certain staff, and calls that go unanswered.
