What the Law Says

Washington’s DUI statute, RCW 46.61.502, makes it unlawful to drive a vehicle while under the influence of alcohol or drugs, or with a prohibited alcohol concentration within two hours of driving. Any criminal case is separate from a civil injury claim, and a charge is not a finding of fault. Impairment evidence can still matter in how a crash is evaluated.

RCW 46.61.400 requires drivers to operate at a speed that is reasonable and prudent for conditions and prohibits driving faster than is safe. Washington also uses comparative fault, so responsibility can be shared among everyone involved in a crash. Anyone hurt in a collision like this should get legal guidance early; Beverly Law works on a no fee unless we win basis.
