What the Law Says

Under RCW 46.61.240, pedestrians crossing a roadway outside a marked crosswalk must yield the right-of-way to vehicles. That rule does not excuse drivers from all responsibility: Washington law still requires drivers to exercise due care to avoid hitting a pedestrian on the roadway. Who was at fault in a crash like this depends on the evidence.

Washington follows pure comparative fault under RCW 4.22.005, meaning a person’s share of fault can reduce, but not necessarily bar, a recovery. Families who lose a loved one in a crash may also have rights under the state’s wrongful death statute, RCW 4.20.010. Every case is different, and no outcome can be promised.

This summary is general information, not legal advice. Every case depends on its specific facts.
