What the Law Says

Washington’s wrongful death statute, RCW 4.20.010, allows a civil action when a person’s death is caused by the wrongful act, neglect, or default of another. Under RCW 4.20.020, the action is brought for the benefit of surviving spouses, children, and certain other family members. Whether a claim exists depends on the facts that investigators establish.

Washington follows a pure comparative fault system under RCW 4.22.005, meaning any fault assigned to an injured person reduces, but does not automatically bar, recovery. In rail and pedestrian cases, how fault is apportioned can be a central issue, which is why preserving evidence early matters.

This summary is general information, not legal advice. Every case depends on its specific facts.
