What the Law Says

Washington’s DUI statute, RCW 46.61.502, makes it unlawful to drive a vehicle while under the influence of alcohol or drugs or at or above the legal alcohol concentration. A driver who violates it and causes injury or death may face criminal charges, and the conduct can also support a civil claim for negligence.

Washington’s wrongful death statute, RCW 4.20.010, allows a civil action when a person’s death is caused by the wrongful act or neglect of another. Certain family members, such as a surviving spouse, children or, in some cases, parents, may be able to bring a claim on behalf of the estate and beneficiaries.
