Texas Transportation Code Chapter 545 sets the rules of the road, including the requirement that drivers operate on the right side of the roadway. A driver who crosses into oncoming traffic and causes a head-on collision may be found to have violated these rules. Evidence such as the crash report, photos and vehicle damage can help show what happened.
Texas Civil Practice and Remedies Code Chapter 33 applies proportionate responsibility, so each party’s share of fault can reduce or bar recovery. An injured person generally cannot recover if found more than 50 percent responsible. Deadlines apply to injury claims, so people hurt in a crash should learn their rights early.
