What the Law Says
Texas Transportation Code Section 545.151 requires drivers approaching an intersection without functioning signals to yield to any vehicle that has already entered the intersection or is approaching from the right. Failing to yield the right-of-way at intersections like Montoya Drive and Redd Road is one of the most common causes of serious T-bone and broadside collisions. When a driver disregards this duty and causes a crash, they can be held civilly liable for the injuries that result.
Texas Civil Practice and Remedies Code Section 33.001 applies the state’s modified comparative fault rule to crash claims like this one. Under this statute, an injured person can still recover damages as long as they are found to be 50% or less at fault for the crash, though their compensation is reduced by their percentage of responsibility. This rule often becomes central to negotiations when, as here, the cause of an intersection crash has not yet been determined.
