What the Law Says

Texas Transportation Code Section 545.351 requires drivers to operate at a speed that is reasonable and prudent under the conditions, and to control speed as needed to avoid colliding with a person or vehicle on the roadway. Drivers must also keep a proper lookout for cyclists, who have the rights and duties of other vehicle operators under Texas law.

Texas uses proportionate responsibility under Civil Practice and Remedies Code Section 33.001, which bars recovery if a claimant is found more than 50 percent responsible and otherwise reduces damages by the claimant’s percentage of fault. Because police say the cyclist allegedly did not stop at a stop sign, how fault is shared may matter, and an independent review of the evidence is important.
