Texas Transportation Code Section 545.351 requires drivers to operate at a speed that is reasonable and prudent under the circumstances, considering road conditions and hazards. A driver who allegedly fails to control speed or the vehicle may be found negligent if that failure causes a crash. Whether this section applies here depends on what the investigation determines.
Texas Civil Practice and Remedies Code Section 71.002 allows certain family members to bring a wrongful death claim when a person dies because of another’s wrongful act or neglect. Injured survivors may separately pursue claims for their own injuries. Families with questions can speak with Beverly Law; there is no fee unless we win.
