What the Law Says

Texas Transportation Code Chapter 552 sets out the duties of drivers and pedestrians, including the requirement that drivers exercise due care to avoid colliding with a pedestrian on a roadway. A driver who fails to use that care may be held responsible for resulting harm.

Texas Civil Practice and Remedies Code Chapter 71 allows certain surviving family members to bring a wrongful death claim when a person dies because of another’s wrongful act or neglect. Every case depends on its own facts, and families can speak with a lawyer who works on a no fee unless we win basis.
