Atascocita crash: Juvenile hospitalized, hit by vehicle while riding electric scooter
Texas Transportation Code Chapter 545 sets the rules of the road for drivers, including the duty to operate a vehicle safely and not recklessly. Section 545.401 defines reckless driving as driving with willful or wanton disregard for the safety of persons or property. Whether a driver breached these duties depends on the facts of each crash.
Texas Civil Practice and Remedies Code Chapter 33 governs proportionate responsibility. Under it, a injured person’s recovery can be reduced by their percentage of fault and barred if it is greater than 50 percent. This is why preserving evidence about how a crash happened matters.
