A 66-year-old truck driver was killed early Thursday morning when the big rig he was driving overturned on southbound Interstate 5 in Yolo County, north of Woodland. The truck was hauling equipment for rapper J. Cole’s Fall-Off World Tour when it drifted onto the right shoulder; when the driver tried to steer back onto the roadway, he lost control and the rig rolled over. No other vehicles were involved, and Cole’s Sacramento concert that night was canceled following the crash.

The Sacramento Bee identified the driver, who was the truck’s sole occupant, as Jarlath Parkinson of South Carolina. CBS Sacramento reported that both southbound lanes of I-5 were blocked while crews cleared the scene, and quoted CHP Sergeant David Barker saying the cause is still unclear: “It’s unknown at this time, may have been a distraction or fell asleep. Unfortunately, the solo occupant did not survive the crash.” The California Highway Patrol’s investigation into the crash remains active.

What the Law Says

California Vehicle Code 21658 requires drivers to keep their vehicle within a single lane as nearly as practical and to change lanes only when it can be done safely. A truck drifting onto the shoulder and then losing control while trying to re-enter the roadway is exactly the kind of lane-discipline failure this statute addresses, and it can support a negligence claim against the driver or trucking company.

Vehicle Code 34501.2 requires commercial truck drivers to follow federal hours-of-service rules limiting how long they can drive without rest, precisely to prevent the kind of fatigue-related crash CHP says it has not ruled out here. If a driver or carrier violated hours-of-service limits, that violation can be powerful evidence of negligence in a wrongful death claim.
