Bicyclist killed in Egger Highlands hit-and-run; police seek suspect
California’s Three Feet for Safety Act, Vehicle Code Section 21760, requires a driver overtaking or passing a bicyclist traveling in the same direction to move into an adjacent lane when possible, or otherwise pass at a safe distance of at least three feet. The law exists precisely to prevent the kind of lane-drift collision investigators describe here, where a vehicle veered into a marked bike lane and struck a cyclist from behind. A driver who violates this statute and causes injury or death can be held civilly liable.
California Vehicle Code Section 20001 makes it a crime for the driver of a vehicle involved in a collision resulting in injury or death to fail to stop, identify themselves, and render reasonable assistance. Fleeing the scene, as the driver in this case is alleged to have done, is both a criminal hit-and-run offense and strong evidence of fault in a related civil claim. Victims’ families can pursue compensation even while a criminal investigation into the fleeing driver remains open.
