A fatal October 2024 collision on Highway 74 near Vista Point in the Palm Desert area is now the inspiration for a new California law. Reports indicate a big rig allegedly lost control and struck a pickup truck whose 27-year-old driver, a La Quinta resident, was on his way to work. The driver of the pickup was killed. Highway 74 is a narrow mountain corridor where heavy trucks share the road with commuters.

The Desert Sun reported that Gov. Gavin Newsom signed a Caltrans transparency bill inspired by the crash. KESQ and MyNewsLA identify it as Assembly Bill 1145, known as “Tristin’s Bill,” authored by Assemblymembers Jeff Gonzalez and Greg Wallis. According to those reports, the law requires Caltrans to weigh the cost of a requested local traffic-safety measure against other options and to give a written explanation when it rejects one, effective January 1, 2027. A Riverside County study cited in the coverage found collision rates on Highway 74 south of Palm Desert were 125% higher than on comparable highways.

What the Law Says

California’s basic speed law requires drivers to travel at a speed that is reasonable and prudent for conditions, including curves, weather, traffic and the width of the road. On a narrow mountain highway, a big-rig driver who goes too fast for the conditions may be found to have violated this rule. Violations can be strong evidence of negligence in a civil injury or wrongful death claim.

California Vehicle Code 21658 requires a vehicle on a roadway with two or more lanes to be driven as nearly as practical within a single lane and not moved from it until the driver has ascertained it can be done safely. A truck that drifts out of its lane and into another vehicle may raise questions under this section. Families who lose a loved one may also have rights under California’s wrongful death laws, and we offer free consultations with no fee unless we win.
