What the Law Says

California Vehicle Code 27803 requires every motorcycle operator and passenger to wear a properly fastened safety helmet that meets federal safety standards. Riding a dirt bike or motorcycle on a public roadway without one significantly increases the risk of fatal head trauma in a crash. Investigators in this case noted that the rider was not wearing a helmet at the time of the collision. Failure to comply with the helmet law can also affect comparative-fault arguments in any resulting injury or wrongful-death claim.

California Vehicle Code 23152 makes it unlawful to operate any vehicle, including a motorcycle or off-highway motorcycle, while under the influence of alcohol or drugs. CHP said alcohol is believed to have been a factor in this crash, which remains under investigation. When impairment contributes to a single-vehicle wreck, it can affect how liability and damages are evaluated in any civil claim connected to the crash. A final determination of impairment typically depends on toxicology results and the completed CHP investigation.
