A 74-year-old Westminster man was struck and killed by a driver while crossing a street in a motorized wheelchair in Huntington Beach, according to the Huntington Beach Police Department. Police said officers were called to a crash at the intersection of Skylab Road and Able Lane around 2 p.m. on Tuesday, Aug. 18, 2026, and found the victim lying unconscious in the roadway.

Based on a preliminary investigation, authorities said the victim was crossing southbound on Skylab Road in a motorized wheelchair when a driver traveling eastbound struck him. As reported by KTLA, the man was taken to a local hospital, where he was pronounced dead. Police said the driver of the Honda, described only as a 45-year-old Los Angeles man, remained at the scene and is cooperating with the investigation. “The driver of the Honda cooperated with investigators, and impairment does not appear to be a factor,” police said, adding that it is unknown whether impairment was a factor for the rider of the wheelchair. The victim’s identity had not been released, and the case remains under investigation. Anyone who witnessed the collision is urged to call HBPD Investigator Rattanchandani at 714-536-5231.

What the Law Says

Under California Vehicle Code § 467, a “pedestrian” includes any person who is operating a self-propelled wheelchair, motorized tricycle, or motorized quadricycle and, because of a physical disability, is otherwise unable to move about as a pedestrian. That means a person crossing a street in a motorized wheelchair has the same legal protections as any other pedestrian, and drivers owe them the same duty of care under California Vehicle Code § 21950.

When a person is killed by the wrongful act or neglect of another, California Code of Civil Procedure § 377.60 allows the surviving spouse, domestic partner, children, and certain other dependents to bring a wrongful death claim. A wrongful death case is a civil matter and is separate from any decision by police or prosecutors about criminal charges.
