Bicyclist dies following collision with car in Hayward
California Vehicle Code 21200 grants bicyclists the same rights and responsibilities as drivers of vehicles on the roadway, meaning motorists must exercise the same duty of care toward cyclists as they would toward other cars. Drivers who fail to yield, turn without checking, or misjudge a cyclist’s right-of-way at an intersection can be held liable for resulting injuries or death. This statute forms the backbone of most bicycle injury claims in California.
California Vehicle Code 21950 requires drivers to exercise due care for the safety of anyone lawfully in a crosswalk or roadway, extending a heightened duty of caution at intersections like Harder Road and Soto Road. When a driver strikes a bicyclist at an intersection, investigators examine right-of-way, speed, and visibility to determine fault under this and related statutes.
