A 62-year-old bicyclist was killed early Monday morning after being struck by a vehicle at the intersection of Harder Road and Soto Road in Hayward, California. The crash happened around 12:10 a.m. The bicyclist was rushed to a hospital, where he later died from his injuries. His name has not been released, pending notification of next of kin.
According to KRON4, the driver involved — a 52-year-old Hayward man — remained at the scene and cooperated with responding officers. KRON4 reported that Hayward police do not believe drugs or alcohol were factors in the collision. The outlet noted the crash marks the city’s fourth fatal collision so far this year. The Hayward Police Department Traffic Bureau is asking anyone with information about the crash to come forward.
California Vehicle Code Section 21200 gives bicyclists all the rights and subjects them to all the duties of a driver operating a vehicle on public roads. That means drivers owe cyclists the same duty of care they owe other motorists, including yielding the right of way at intersections. When a driver fails to see or yield to a cyclist lawfully using the roadway, that failure can be the basis for a negligence claim in a wrongful death case like this one.
California’s basic speed law, Vehicle Code Section 22350, requires drivers to travel at a speed that is safe for current conditions, regardless of the posted limit. Darkness or reduced visibility late at night can lower what counts as a safe speed at an intersection. If investigators determine a driver was traveling too fast for conditions at the time of a fatal collision, that finding can support a claim of negligence.
