What the Law Says

California Vehicle Code 20001 requires any driver involved in a collision that causes injury or death to immediately stop at the scene, identify themselves, and render reasonable assistance. Fleeing the scene, as the driver in this crash allegedly did, is a separate crime from the underlying collision and can be charged as a felony when a victim dies. Investigators use surveillance footage, vehicle debris, and paint transfer evidence to identify hit-and-run drivers even after they leave the scene.

California Vehicle Code 21950 gives pedestrians the right-of-way in marked and unmarked crosswalks and requires drivers to exercise due care for pedestrian safety at all times, including along roadway shoulders where workers may be present. Drivers who strike a pedestrian working along a highway can be held civilly liable even in the absence of criminal charges. A pedestrian’s own conduct can reduce, but does not automatically eliminate, a driver’s liability under California’s comparative negligence rules.
