What the Law Says

Washington’s following-too-closely law, RCW 46.61.145, requires a driver not to follow another vehicle more closely than is reasonable and prudent, with due regard for speed, traffic and the condition of the highway. When a rear-end collision involves a motorcycle, how much distance the following driver kept is often a central question. Investigators typically look at the vehicles’ positions, speeds and any available evidence.

When a crash results in a death, Washington’s wrongful death statute, RCW 4.20.010, allows a civil action for damages to be brought when a death is caused by the wrongful act or neglect of another. Under RCW 4.22, fault may be shared between parties, so the facts of each crash matter. Families with questions can learn their options, and a no fee unless we win arrangement means no upfront cost.
