Serious crash injures two on Dallas North Tollway, related diesel spill prompts HazMat response
Texas Transportation Code Section 545.401 makes it unlawful to drive a vehicle in willful or wanton disregard for the safety of persons or property. When a commercial truck strikes multiple vehicles and a wall before overturning, investigators look at speed, following distance and load securement to determine whether the driver’s conduct crossed into reckless driving. A finding of recklessness can support both criminal citations and civil liability for the resulting injuries and property damage.
Because this crash involved six vehicles, fault may be shared among more than one driver. Texas Civil Practice and Remedies Code Section 33.001 applies the state’s proportionate responsibility rule, allowing an injured person to recover damages as long as their own share of fault does not exceed 50 percent, with any award reduced by their percentage of responsibility. This statute often governs how compensation is divided in multi-vehicle pileups like this one.
