What the Law Says

Texas Transportation Code Section 552.005 governs how a pedestrian may cross a roadway at a point other than a marked crosswalk, requiring them to yield the right-of-way to vehicles on the roadway. It’s a key provision in crashes like this one, where a pedestrian is struck on a highway such as FM 620 that lacks crosswalks for long stretches. Investigators typically weigh this statute alongside driver conduct to help determine how fault should be apportioned.

Texas Transportation Code Section 550.021 requires the driver of any vehicle involved in a collision that results in injury or death to stop immediately at the scene, determine whether anyone needs aid, and remain until the requirements of the law are met. Leaving the scene of a fatal crash is a second-degree felony in Texas. Authorities say the driver in this crash stayed and cooperated, which is what this law requires of every motorist involved in a serious collision.
