A 20-year-old pedestrian was killed late Thursday night after being struck by a vehicle on the U.S. Highway 83/277 frontage road about five miles north of Hawley in Jones County, Texas. The victim, identified as Alexis Ivan Jimenez of Rio Grande City, was walking in the roadway when he was hit by a southbound 2013 Cadillac driven by a 16-year-old girl from Hawley. Jimenez was rushed to Anson General Hospital, where he was pronounced dead just after 1 a.m. Friday by Jones County Justice of the Peace Cheryl Guernsey. The teenage driver was wearing her seat belt and was not injured in the crash.

San Angelo LIVE reported that the posted speed limit on the frontage road is 55 mph and that no other vehicles were involved in the collision. DPS said the crash remains under active investigation, and no citations or charges have been announced. Authorities have not said whether Jimenez was wearing reflective clothing or why he was walking in the roadway at that hour.

What the Law Says

Texas law requires pedestrians who walk along a roadway with no adjacent sidewalk to walk on the left side facing oncoming traffic, so both the pedestrian and approaching drivers have the best chance to see each other in time. This provision is directly relevant to a rural, unlit frontage road like the one where Jimenez was struck at night. Whether a pedestrian complied with this rule can factor into how fault is apportioned in a wrongful death claim.

Texas law also imposes an independent duty on drivers to exercise due care to avoid colliding with a pedestrian on a roadway, regardless of whether the pedestrian had the right-of-way at that location. This duty applies squarely to a nighttime frontage-road crash like this one, where a driver’s ability to see and react to a person in the roadway is critical. A driver’s failure to keep a proper lookout can support a finding of liability even where a pedestrian was also negligent.
