A driver was killed late Tuesday night after slamming into the back of a U.S. Postal Service 18-wheeler on the West Sam Houston Tollway near Briar Forest on Houston’s west side. The impact was severe enough to overturn the postal truck and leave the driver’s black Honda SUV suspended on top of a barrier near an overpass. The driver was ejected from the SUV and died at the scene, while other occupants of the vehicle suffered minor injuries. Authorities say the driver is believed to have been intoxicated at the time of the crash.

According to ABC13 Houston, the Harris County Precinct 5 Constable’s Office responded to the crash around 10 p.m. and shut down part of the tollway while crews worked the scene. By Wednesday morning, cleanup crews were still clearing debris and repairing a damaged guardrail. Click2Houston reported the crash occurred at 10001 West Sam Houston Parkway North, in front of Grace Church, and that the passenger vehicle struck the rear of the USPS truck, causing it to overturn, with photos showing the SUV hanging over the overpass edge. The Precinct 5 Constable’s Office continues to investigate the circumstances of the crash.

What the Law Says

Texas Penal Code Section 49.04 makes it a criminal offense to operate a motor vehicle in a public place while intoxicated. When impaired driving is a suspected factor in a fatal or injury crash, it can support both criminal charges against the driver and a civil claim for the injured victims. Toxicology results and the official crash report typically play a central role in establishing intoxication.

Texas Transportation Code Section 545.062 requires drivers to maintain an assured clear distance behind the vehicle ahead so they can safely stop without colliding with it. A rear-end collision into a truck, like the one on the West Sam Houston Tollway, can point to a violation of this following-distance rule, which is often cited as evidence of negligence in civil injury claims.
