An adult riding a scooter on the freeway was struck and killed on northbound MoPac (Loop 1) at 45th Street early Wednesday, according to the Austin Police Department. APD said the crash happened at about 5:10 a.m. on Wednesday, Aug. 26, 2026, and involved a vehicle and a pedestrian. Austin-Travis County EMS confirmed the pedestrian was riding a scooter on the highway when the vehicle hit them, and identified the rider as an adult who first responders said died at the scene.
As reported by KXAN, police said that by 5:36 a.m. all traffic was being forced to exit the highway at 45th Street and northbound MoPac was shut down up to the 4700 block, with drivers urged to find another route. TxDOT cameras still showed traffic diverted around the scene as of 8 a.m. The rider’s name and age have not been released, and police have not said whether the driver stayed at the scene or whether any citation is expected. The investigation is active and no arrest, citation or charge has been reported.

Texas Civil Practice and Remedies Code § 71.002 allows a surviving spouse, children and parents to bring a wrongful death claim when a person is killed by another’s wrongful act, neglect, carelessness or unskillfulness. The claim belongs to those family members, and Texas generally gives them two years from the date of death to file it.
Texas Civil Practice and Remedies Code § 33.001 is the rule that decides these cases. A jury assigns a percentage of responsibility to everyone involved, and the family still recovers as long as the person who died was not more than 50 percent responsible — their share simply reduces the award.
