What the Law Says

California Code of Civil Procedure § 377.60 allows a surviving spouse, children and certain other family members to bring a wrongful death claim when a person is killed by the wrongful act or neglect of another — including a commercial truck driver and, in many cases, the trucking company that employs them.

California Vehicle Code § 21650 requires every vehicle to be driven on the right half of the roadway. When a tractor-trailer crosses the center line into oncoming traffic, that failure can support both a traffic violation and a civil negligence claim against the driver and the motor carrier.

This summary is general information, not legal advice. Every case depends on its specific facts.
