According to published reports, the vehicle did not stay at the scene, and police later located and stopped it. The Modesto Police Department is investigating, and police said the driver may have been under the influence of drugs, though whether impairment contributed to the crash has not been determined.

What the Law Says

California Vehicle Code section 21950 requires drivers to yield the right-of-way to pedestrians crossing the roadway, and drivers must still exercise due care for pedestrians in the road. A driver who fails to do so may be held civilly liable for the resulting harm.

California Vehicle Code section 20001 requires a driver involved in a crash that injures or kills someone to stop at the scene and provide information and assistance. Leaving the scene can bring criminal penalties, and a family may also have a wrongful death claim under Code of Civil Procedure section 377.60. Families can talk with Beverly Law, and there is no fee unless we win.
