What the Law Says
Washington’s vehicular homicide statute, RCW 46.61.520, makes it a felony to cause a death while driving under the influence, recklessly, or with ordinary negligence. In cases involving alleged alcohol use and excessive speed, like this one, prosecutors often pursue the DUI or reckless-driving prong, which carries the most serious penalties under Washington law. A conviction can bring years of prison time and license revocation.
RCW 46.61.522 defines vehicular assault as causing substantial bodily harm to another person while driving under the influence, recklessly, or with disregard for the safety of others. When a crash injures multiple occupants, as authorities say happened here, prosecutors can file a separate vehicular assault count for each injured victim. It is a class B felony in Washington.
