What the Law Says
Texas law requires that a driver never back up a vehicle unless the movement can be made safely and without endangering others. This duty is especially critical in residential driveways, where young children may be present and difficult to see in a vehicle’s blind spots. When a backing maneuver injures a bystander, it can serve as strong evidence of a driver’s failure to exercise reasonable care under Texas Transportation Code Section 545.415.
Texas Transportation Code Section 545.401 defines reckless driving as operating a vehicle in willful or wanton disregard for the safety of persons or property. While most driveway collisions stem from simple negligence rather than recklessness, investigators examining the circumstances of this crash – including speed, visibility and the driver’s attentiveness – will determine whether this standard applies. A finding of recklessness can support both criminal charges and civil liability for the injuries caused.
