A bicyclist was killed Thursday morning after being struck by a dump truck on westbound Tully Road near the Highway 101 on-ramp in San Jose. The crash happened around 7:45 a.m. during the morning commute, when the adult male victim was riding an electric bicycle in the marked bike lane. He was pronounced dead at the scene. The dump truck driver stayed at the scene and is cooperating with investigators.
According to KRON4 and KTVU, police shut down westbound Tully Road from South King Road to the Highway 101 on-ramp for an extended period while officers documented the scene and collected evidence. Investigators said drugs and alcohol do not appear to be a factor in the crash. KTVU reported the death marks San Jose’s 32nd traffic fatality of 2026, compared to 22 at the same point last year, and that the crash site falls within the city’s Vision Zero corridor aimed at eliminating traffic deaths. The victim’s identity had not been released as of publication.
California Vehicle Code 21208 requires bicyclists traveling slower than traffic to use a designated bike lane, and correspondingly obligates motorists to exercise heightened care around cyclists using those lanes. When a large vehicle like a dump truck strikes a cyclist riding within a marked bike lane, it raises questions about the driver’s mirror checks, blind-spot awareness, and turning or merging maneuvers near the lane.
California Vehicle Code 21750 sets the general duty for a driver to pass a bicyclist at a safe distance, and Vehicle Code 21760 (the Three Feet for Safety Act) specifically requires drivers to leave at least three feet of clearance when overtaking a cyclist. Commercial vehicles, including dump trucks, are held to these same rules, and a violation can be strong evidence of negligence in a wrongful death claim.
