A 15-year-old was seriously injured and a passenger suffered minor injuries Wednesday morning when their all-terrain vehicle crashed on a dirt road in far East El Paso County, Texas. The teen was driving a blue Yamaha ATV at high speed around 9:06 a.m. when it went over a dirt berm in the 13500 block of Timothy Drive, near Desert Wind School, causing the driver to lose control. Both riders were taken to a hospital, with the driver’s injuries described as serious. The El Paso County Sheriff’s Office’s Special Traffic Investigators unit responded and took over the crash investigation, which remains active.

KFOX14 first reported the crash, citing the El Paso County Sheriff’s Office. Sheriff Oscar Ugarte said the incident “is a serious reminder that ATVs can be dangerous, particularly when operated at high speeds,” and urged parents and riders to wear proper protective equipment and operate the vehicles responsibly, according to the outlet. KVIA separately confirmed the crash location and injuries, reporting that the passenger was also hospitalized. No arrests or citations had been announced as of the last update, and investigators had not released the names of those involved.

What the Law Says

Texas regulates the operation of all-terrain vehicles under Transportation Code Chapter 663, the Off-Highway Vehicle Act. Section 663.034 requires anyone operating or riding an ATV on public property to wear a DOT-compliant helmet and eye protection, and additional rules restrict how minors may operate these vehicles. When a rider is hurt because required safety gear wasn’t used or an ATV was operated recklessly, these standards can factor into who is found responsible for the crash.

Because more than one person can share fault in an ATV crash, Texas applies the proportionate responsibility rule found in Civil Practice and Remedies Code Chapter 33. Under Section 33.001, an injured person can still recover damages as long as their own share of fault does not exceed 50 percent, with any award reduced by their percentage of responsibility. This framework determines how compensation is calculated when a minor driver, a passenger, and property conditions may all have contributed to a crash.
