An adult man was killed Monday night after being struck by a Union Pacific freight train on the railroad tracks near Ardith Drive and Calvine Road, right at the Sacramento-Elk Grove border. The collision was reported around 8:42 p.m. to the Sacramento Metropolitan Fire District, which found the man had already died at the scene. Both eastbound and westbound lanes of Calvine Road were shut down for hours while crews investigated. Because the crossing sits on the line between jurisdictions, both the California Highway Patrol and the Elk Grove Police Department are involved in piecing together what happened.

According to CBS News Sacramento, the man has not yet been publicly identified, and the circumstances that led to him being on the tracks were not immediately released by authorities. Fox40 reported that Sacramento County authorities are investigating the fatal train strike alongside Union Pacific. Officials have not said whether the crossing’s warning signals were functioning at the time, and the investigation into exactly what happened remains open.

What the Law Says

California Vehicle Code Section 22451 requires both drivers and pedestrians to stop before a railroad crossing whenever a signal device or flagman warns of an approaching train, or when a train is plainly visible or audible and close enough to pose an immediate hazard. This crossing-safety rule applies at every marked grade crossing, including the Calvine Road crossing where this collision occurred, and violations can factor heavily into who bears fault when a pedestrian or vehicle is struck.

California Penal Code Section 369i makes it a misdemeanor to enter or remain on railroad property, including the tracks and the land within 20 feet on either side, when that presence interferes with or endangers the safe operation of a train. This statute governs unauthorized access to active rail corridors like the one along Calvine Road and can be relevant to how liability is examined in a fatal trespass-related strike.
