What the Law Says

California Vehicle Code section 23153 makes it unlawful to drive under the influence of alcohol or drugs and, while doing so, break another traffic law or neglect a legal duty in a way that causes bodily injury to another person. It is a separate offense from simple DUI under section 23152. Criminal charges are brought by prosecutors, while injured people and families may have separate civil rights to seek compensation.

California Vehicle Code section 20001 requires a driver involved in a crash that injures or kills someone to stop immediately at the scene, give identifying information and render reasonable aid. Leaving the scene of a crash that causes death or serious injury can be charged as a felony. This duty applies regardless of who is at fault for the collision.
